Snapshark Terms of Use

These Terms of Use ("Terms") govern your access to and use of the websites, applications, and services provided by Snapshark.app, Inc. ("Snapshark," "we," "our," or "us"), including Snapshark.app, related websites (the "Site"), applications (the "App"), and services such as photo and video storage, printing, hosting, digitization, and sharing (collectively, the "Services").

By accessing or using the Services, you agree to be bound by these Terms and all incorporated policies, including our Privacy Policy and Biometric Information Privacy Policy.

IMPORTANT: These Terms include a binding arbitration agreement and a waiver of class actions. Please review Section 14 carefully.

1. Acceptance of These Terms

If you do not agree to these Terms, you must not access or use the Services or submit any information or content to Snapshark.

2. Eligibility

You may use the Services only if you are at least eighteen (18) years old, capable of forming a binding agreement, and not prohibited from using the Services under applicable law.

3. Accounts and Subscriptions

3.1 Accounts

Certain features require you to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities occurring under your account.

Paid Accounts automatically renew unless canceled prior to renewal. Fees are non-refundable except where required by law or expressly stated.

4. Acceptable and Prohibited Use

You agree not to misuse the Services. Prohibited conduct includes unauthorized access, scraping, uploading illegal or infringing content, harassment, impersonation, or distribution of malicious software.

5. Content and User Uploaded Content

5.1 Ownership

You retain ownership of the content you upload. You are solely responsible for ensuring you have all necessary rights to upload and use your content.

5.2 License to Snapshark

By uploading content, you grant Snapshark a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and process such content solely to operate and provide the Services.

6. Privacy

Your use of the Services is governed by our Privacy Policy and Biometric Information Privacy Policy.

7. Indemnification

You agree to indemnify and hold harmless Snapshark from claims arising out of your breach of these Terms or misuse of the Services.

8. Modifications

Snapshark may modify these Terms at any time by posting an updated version. Continued use of the Services after notice constitutes acceptance of the revised Terms.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SNAPSHARK SHALL NOT BE LIABLE FOR INDIRECT OR CONSEQUENTIAL DAMAGES. TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE PRECEDING TWELVE (12) MONTHS.

11. Termination

Either party may terminate these Terms at any time. Provisions that by their nature should survive termination shall remain in effect.

12. Governing Law

These Terms are governed by the laws of the State of Colorado, except as provided in the Arbitration Agreement.

13. Arbitration Agreement

Any dispute arising out of or relating to these Terms or the Services shall be resolved by final and binding arbitration on an individual basis.
